Terms of Service
These Terms of Service ("Terms") are an agreement between you and TacTile ("TacTile," "we," "us"). They govern your use of the TacTile platform — the dashboard and apps at tactile.to, our mobile apps, this website, and every destination page we host and serve on your behalf. By creating an account or using the service, you agree to these Terms.
The service
TacTile lets you program NFC tags and generate QR codes ("triggers") that route the people who tap or scan them to destinations you create and manage — digital business cards, menus, forms, documents, videos, Wi-Fi credentials, links, and other content. Routing is dynamic: you can change where a trigger points without reprinting a code or reprogramming a tag. The platform also records analytics about tap and scan activity so you can see how your triggers perform.
Accounts
You need an account to use most of the service. Provide accurate information, keep it current, and keep your credentials secure — you are responsible for all activity under your account. Accounts are for a single user today; don't share credentials as a substitute for separate accounts. You must be at least [placeholder for counsel: minimum age] and able to form a binding contract to use the service.
Acceptable use
TacTile routes physical taps and scans to web content, which means misuse can reach people who never chose to interact with you beyond touching a tag or scanning a code. Because of that, these rules are strict. You must not use the service to:
- host or route to unlawful, infringing, or harmful content;
- run phishing, credential harvesting, malware distribution, or any deceptive redirect — including pointing a trigger at content that misrepresents who operates it or where it leads;
- send spam or route people to it;
- circumvent plan limits, safety caps, or metering, including with automated scripts;
- probe, disrupt, or gain unauthorized access to the platform or to other customers' accounts, destinations, or analytics.
We may review destinations for abuse, and we may disable any destination, link, or trigger routing — or suspend the account behind it — that we reasonably believe violates these rules. Where end users are at risk (for example, a phishing page behind a QR code), we may do so immediately and without prior notice.
Your content
You own the content you upload to or create in TacTile. So that we can operate the service, you grant us a worldwide, non-exclusive, royalty-free license to host, store, reproduce, transmit, and display that content — for example, serving your destination page to someone who scans your code, caching it on a CDN, and keeping backups. The license exists only to provide the service and ends when you delete the content, subject to a short lag for backups. You are responsible for having the rights to everything you upload. TacTile's own software, branding, and site content remain ours and our licensors'.
End users and analytics
When someone taps your tag or scans your code, we record an analytics event for you: a timestamp, coarse location, device type, and a hashed visitor identifier used to distinguish unique from repeat visits. We process this data to provide the service to you. You are the one with the relationship to the people scanning your triggers, so you are responsible for ensuring you have a lawful basis for that collection and for giving end users any notice required by the privacy laws that apply to you. Our own handling of personal data is described in our Privacy Policy.
Plans, billing & cancellation
TacTile offers a Free plan and paid plans (currently Plus and Pro). Payments are processed by Stripe; we don't store your card details. Paid plans are billed in advance, monthly or annually. You can upgrade, downgrade, or cancel at any time from the dashboard: plan changes are prorated, cancellation keeps paid features until the end of the current period, and annual subscriptions cancelled early are prorated and refunded. If we change prices, we'll give you advance notice and the new price takes effect at your next billing cycle.
"Unlimited" features are subject to the published safety caps, which exist to prevent abuse rather than to limit normal use. Destination storage is metered in credits according to your plan. On the Free plan, destinations require an annual check-in; a destination that isn't confirmed goes dark — your trigger stays intact, but scans land on a page saying the destination is no longer active.
Service availability
We work to keep TacTile fast and reliable, but self-serve plans come with no uptime guarantee or service-level agreement. The service — including destination pages served to end users — may occasionally be unavailable for maintenance, upgrades, or reasons outside our control, and features may change over time. If your deployment needs contractual availability commitments, contact sales about an enterprise agreement.
Physical products
If you purchase physical products from us, such as NFC tags, the order terms shown at purchase apply, including [placeholder for counsel: shipping, returns, and warranty terms for physical products]. Nothing in these Terms overrides statutory consumer rights that apply to physical goods where you live.
Termination
You can stop using the service or delete your account at any time. We may suspend or terminate your access for violating these Terms, for non-payment, or where required for legal or security reasons; where practical we'll notify you first. When an account closes, its destinations stop resolving and triggers pointing at them will no longer work. You will have [placeholder for counsel: data export and retention window] to export your content after termination.
Disclaimers & limitation of liability
Plainly: the service is provided "as is" and "as available." We don't promise it will be uninterrupted or error-free, and to the extent the law allows we disclaim implied warranties, including merchantability and fitness for a particular purpose. To the same extent, neither of us is liable to the other for indirect, incidental, or consequential damages — such as lost profits or lost business — and our total liability under these Terms is capped at [placeholder for counsel: liability cap — e.g., fees paid in the twelve months before the claim]. Nothing in these Terms limits liability that cannot be limited by law.
Governing law
These Terms are governed by the laws of [placeholder for counsel: governing law], and disputes will be resolved in [placeholder for counsel: venue and dispute-resolution mechanism].
Changes
We may update these Terms as the service evolves. If a change is material, we'll notify you — by email or in the dashboard — before it takes effect. Continued use of the service after a change takes effect constitutes acceptance of the updated Terms.
